| 摘 要： | 盗掘古文化遗址、古墓葬罪是1997年刑法新增加的犯罪，它侵犯的是双重客体，犯罪对象是具有历史、艺术、科学价值的古文化遗址、古墓葬；客观方面盗掘行为是单一的实行行为；主观方面是故意，以非法占有为目的，属于主观的超过要素。既遂的认定应以盗掘行为的完成作为区分标志。
