| 摘 要： | 刑法方法论存在着本体论和工具论之分,前者以超法规的刑法理论或制度为对象,构建的是作为哲学的刑法学;后者则以解释具体的刑法规范为目的,建构的是作为解释的刑法学。适应刑法学科自身特性并根据刑法正义性的要求,未来中国刑法学发展的趋势应当是实现从刑法本体方法论向刑法工具方法论的范式转型,未来刑法方法论的发达则是构建一套精密的刑法解释方法和技巧,走向解释的刑法学。而其基本的路径则是由实质的犯罪论上升到实质的刑法立场,并提倡与之相适应的实质的刑法解释学。

| Abstract: | The paper is trying to do some research on the methodology of criminal law and to analyze the dispute between ontology and epistemology in that methodology.With a view to finding out a new road to criminal justice, the author makes a suggestion that, for the characteristics of criminal law, a substantial interpretation is the best-adaptable method. |
