关于《海牙规则》第10条的理解和解释问题--兼论《海牙规则》在我国的适用

<海牙规则>是有关提单和国际海上货物运输合同领域当事人权利义务关系的国际实体私法条约,我国没有加入该条约.<海牙规则>在我国涉外海事审判中不能直接适用,但是,基于冲突规范的指引,<海牙规则>在我国可以作为准据法间接适用.<海牙规则>第10条不应作限制解释,不应成为其在我国间接适用的阻碍.

Problems on the Comprehension an d Interpretation of Article 10 of Hague Rules--Concurrently consider the application of Hague Rules in China

Hague Rules is a private international substantive convention on parties'rights and duties in bills of lading and contracts for international carriage of goods by sea.Our country isn't contracting state.Hague Rules can't be applied directly in our country's maritime trial including foreign elements.But,it can be applied indirectly as applicable law based a guide from conflict rules.Article 10 of Hague Rules shouldn't be interpretated restrictly,isn't a barrier that Hague Rules can be applied indirectly in our country.
