与行政决策听证有关问题的思考

行政决策失误不仅给国家资源造成了极大的损失和浪费,而且损害了老百姓的利益,损害了政府在老百姓心目中的形象。行政决策听证具有一定的必要性,将听证制度引入行政决策领域符合了我国处于社会转型时期利益主体多元化、各种矛盾凸现的现实需要,也顺应了人类历史和法治发展的客现趋势,是未来制定统一的行政程序法典时应当通过立法予以确认的。同时,行政程序法也应当对具体的规则,如是否适用"案卷排他规则"以及政府回应机制这样的配套制度予以明确。

The errors in executive decision not only bring about great loss and waste to public resources,but aslo damage the interest of the people and spoil the authority and image of the government.The establishment of hearing in executive decision is of great necessity.After a few years of development,our society is now in a peri- od of transformation,which means there are great variety of interest groups and more conflicts.Also the estab- lishment of hearing system complys with the trend of human history and the need of rule of law,which shoule be confirmed in the future uniform administrative proceedingslaw.In the meantime,certain rules such as whether ad- mits the principle of record exclusiveness or not and the establishiment of government response mechanism should be confirmed in the uniform administrative proceedings law.
