刑事简易程序评析

刑事简易程序的设立,适应了我国刑事诉讼制度的发展。但作为新设立的特别审判程序,刑事简易程序尚需不断完善。从现行法律的相关规定及司法实践看,简易程序所存在的主要问题是简易化和正当化的关系尚未得到妥善的处理。具体表现在简易程序的内容规定及司法操作不够具体和完善,简易程序的结构设计不够理想等方面。

As a special newly put up trial procedure, the simple criminal procedure still needs constantly improving.From the viewpoint of the related provisions of the currently effective laws, the major problem that exists in the simple procedure is that the relation between the simplification and justification still has not been properly dealt with, which concretely shows that the provisions of the simple procedure and the judicial operation are not detailed and perfected, and that the structural designation of the simple procedure is not ideal enough.
