关于“刑讯逼供”的逻辑考量

Ahhough it is prohibited by China＇ s legislation, some investigators still firmly believe “presumption of guilt” as a “magic weapon” and therefore resulting in injustice. Extortion of confession by torture has not only ravaged the justice and dignity of law, but damaged the image of judiciary organs and accumulated negative energy in society. The reasons why extortion of confession by torture is hard to be eradicated involve legal system, ideology, society, etc, among which the logical reason has remained a high-level but most-overlooked one. Legal provisions are concrete manifestation of logic requirements, and extortion of confession by torture not only violates relevant laws or regulations, but goes against the logic requirements.
