| 摘 要： | 驱逐出境与引渡作为涉外管辖中两种相互独立的制度，在性质、法律依据等方面存在明显的区别，但随着国际刑事司法协助和警务合作的发展，驱逐出境日益成为无引渡条约情况下各国开展合作共同打击犯罪，实现遣返的一种替代措施。

| Abstract: | As two mutually independent systems in foreign jurisdiction, deportation and extradition have clear distinctions in nature, legal basis, etc. But with the development of international legal assistance and police cooperation, deportation is being an alternative means of extradition to cooperate to combat crime and to achieve repatriation in a case of non-treaty. |
