| 摘 要： | 生态补偿与生态赔偿是两个不同的法律概念。生态补偿主体在范围上小于生态受益主体,生态受偿主体即生态受损主体。生态补偿的条件根据生态补偿性质的不同而异。生态补偿的标准应高于生态受损主体的损失才能发挥其激励功能。生态补偿的资金来源应多元化,生态补偿的方式也应多样化。

| Abstract: | The ecological expiation and the ecological compensation are different legal concept,the subject of the former narrower than that of the latter.The condition of the ecological expiation varies with the nature of the ecological expiation.The expiation sum should be larger than the loss of the subject to exert its function of stimulation.The fund of the ecological expiation must come from various sources,and the means of the ecological expiation should be varied. |
