惩治外逃贪官的国际刑事司法协助解决机制探析

由于我国与外国在国际刑事司法协助方面存在诸多的问题和障碍，外逃贪官越来越多。今年5月6日，中行开平案两主犯许超凡和许国俊在美国被判刑，开创了中外合作共同打击外逃贪官的新模式。以“二许”案为切入点，探讨我国打击外逃贪官的国际刑事司法协助解决机制存在的问题及对策。

A Probe on International Judicial Criminal Cooperation Mechinism in Cracking Down Corrupt Officials Fleeing to other Countries

Due to the problems and barriers existing in judicial criminal cooperation between China and other countries, the number of corrupt officials fleeing to other countries is increasing rapidly. In May 6th, 2009, two principal criminals in China Bank Kaiping Branch were sentensed to prison in America and this case originated a new mode of international cooperation in cracking down corrupt officials fleeing to other countries. Taking this case as a starting point, this paper discusses the existing problems and countermeasures for international judicial criminal cooperation mechanism in cracking down corrupt officials fleeing to other countries .
