中俄森林资源刑事法律责任制度比较研究

森林是人类生存和发展的基础,其在维护生物多样性和国家生态安全方面发挥着重要的作用。尤其对于像我国这样一个森林资源分布不均、结构不合理、人均相对贫乏的发展中国家,更显得十分重要。如何遏制我国森林资源恶化的趋势以及如何实现森林资源的可持续发展,已成为当务之急。从分析中俄森林环境资源现状入手,通过中俄森林现状、刑事法律责任制度对比、分析,指出中国森林资源保护刑事法律责任方面的不足是导致森林资源恶化的主要原因,进而提出完善我国森林资源刑事法律责任制度的建议。

Comparative Research on Criminal Legal Liability System of Forest Resource of both China and Russia

Forest is the foundation of human survival and development.It plays an important role in maintaining bio-diversity and national ecological security.Especially to China, as a developing country with forest resources misdistribution and unreasonable structure and per capita relatively poor.How to prevent a trend of the forest resources worsening of our country and how to realize the sustainable development of the forest resources, which have already become main task.This text starts with analyzing the forest environmental resources current situation of forest resources of China and Russia,comparing with criminal legal liability system between them,pointing out the deficiency of the criminal legal liability of forest resources protection of our nation,it is the main reason that cause the forest resources worsening,and then putting forward suggestions to perfect the criminal legal liability system of forest resources of our country.
