| 摘 要： | 当前,日益严重的腐败形势与不断加大的反腐力度"并行不悖",被喻为反腐困境。形成该困境的原因很多,其中"重打击受贿,轻打击行贿"的反腐策略难辞其咎。这一策略在客观上纵容了行贿人,损害了法律权威,并可能导致司法裁量权的滥用。要铲除腐败的土壤,就必须改变这一策略,在行贿罪立法上取消"谋取不正当利益"和"财物"两个要件的限制。

| Abstract: | Currently,the corruption situation is more serious day by day while the strength of anti-corruption is increasing,we called it anti-corruption dilemma.Many reasons account to this dilemma,but the anti-corruption strategy of ＂pay attention to punish accepting bribes,but not giving bribes＂ shall be blamed.This strategy is to connive bribers objectively,damaged the authority of law and may results to the abuse of judicial discretion.In order to root out the soil of corruption,this strategy shall be changed and two restrictions on elements of crime shall be abolished in the legislation of bribery,that is,＂seeking improper benefit＂ and ＂property＂. |
