“责任本质”上的对立学说问题辨析

大陆法系刑法学之“责任”与我国大陆地区刑法学中的“刑事责任”存在本质区别，故对“责任本质”的考察不应立足于我国大陆地区之“刑事责任”。责任的“本质”应该与责任的“基础（或对象）”、“内容（或判断要素）”相区分。目前，在“责任本质”学说方面，存在道义责任论、社会责任论与法的责任论的对立。

Differentiations on Theories Opposing of ＂Liability Essence＂

The concept of liability in the criminal law theory of continental legal system is different from criminal liability in Chinese Mainland. So, when reviewing on the question of liability essence, the base point should not be set on the criminal liability in Chinese Mainland. The liability essence should be differed from the liability basis （or object）, content （or judging elements）. At present, on the question of liability eSsence, there are conflicts between the liability theory of morality, the liability theory of society and the liability theory of law.
