海事强制令的限制适用条件

海事强制令有利于快速、有效解决某些海事纠纷 ,但同时也容易给被请求人带来不公。本文从海事强制令的性质入手 ,结合英国相关法律制度 ,对海事法院签发海事强制令时所应考虑的合理因素作了初步讨论。

On the Limited Condition for Issuance of a Maritime Mandatory Order

It is clear that a maritime mandatory order will be useful to deal with some maritime dispute effectively and shortly, but it also will easily do serious harm to the other party, so the issuance of a maritime mandatory order must be given subject to several limited conditions. This paper expounds which factors the judge should bear in mind before he gives a maritime mandatory order and whether the three conditions provided for in Article 56 of Special Maritime Procedure Law are of full consideration or not.
