行业协会的垄断问题研究

在全球化第三部门兴起的语境下,作为非营利性社团法人的行业协会无疑将显示其独特的制度功能。但在中国"双重管理"的社团治理模式下,其弊端在竞争法的视野中也逐步凸显。因此应当在明确行业协会能够成为《反垄断法》上"经营者"的基础上,进一步对其垄断问题进行类型化分析,以此指出行业协会为当前《反垄断法》所规制的重心所在。

Study on the Monopolistic Issues of Trade Association

In the context of globalization and the rise of the third sector,the trade association,as the non-profit corporation,undoubtedly shows its unique institutional functions.But its defects,in the perspective of competition law,have been more and more obvious under the "dual management" mode of corporation governance in China.Therefore,we should analyze the categorization of monopolistic issues on the premises that trade association can be the "undertaking" in Anti-monopoly Law,and finger out that trade association is the key point of the regulation of Anti-monopoly Law in current China.
