代履行制度本质上属于直接强制执行方式；将它称为“代执行”更符合它的本质特征.代履行人属于行政助手,他没有自己独立的意志,他必须按照行政机关的指示来完成行政任务.代履行制度应该是一个整体性的公法关系,因此行政机关与代履行人之间的关系应该是公法关系,而不是民事委托代理关系.在公私协力背景下,代履行制度是私人协助行政机关完成行政任务在秩序行政领域的一个表现；随着越来越多的私人主体开始承担履行行政任务,行政法发生了变革.

Rethinking on Substitute Performance System in Administrative Compulsory Law——Also on the changes of new administrative law in the context of public and private partnership

Substitute performance system is essentially a way of direct compulsory enforcement and in line with its essential nature. Substitute performer is an administrative assistant who does not have own independent will and must complete the administrative tasks followed by the instructions from administrative organs. Substitute performance system should be an integrated relation of public law, therefore the relation between administrative organs and substitute performer should be relation of public law rather than a civil agency relation. In the context of public and private partnership, substitute performance system is that a private assists administrative organs to complete administrative task in administrative areas. With more and more private actors performing administrative tasks, administrative law has changed.
