On the Efficacy of Imposition and Disposition in the Transfer of Patent Rights

Starting from the concept of the contract of patent right transfer, and based on the theories of imposition and disposition of private law, together with the correlative regulations in Patent Law and Contract Law, this article discusses the different legal efficacy between imposition and disposition in the transfer of patent rights so that to emphasize the importance of the application of the theory of private law to the intellectual property law.
