程序视角下的劳动教养制度研究

目前的劳动教养制度已不能适应当今社会的发展，而且不符合分权制衡的法理。可能导致权力滥用。从建设和谐社会的目标出发，有必要从程序上完善劳动教养制度：劳动教养的决定权必须由人民法院行使；公安机关仅负责调查、取证、向法院提出对当事人劳动教养的请求；同时应该加强检察机关对公安机关的监督。最终做到劳动教养制度的公开、公正。

On the System of Reeducation through Labor from the Angle of Procedure

The Reeducation through Labor in China is not suitable for the development of society . the principle of power separation, and it may inducing abusing of power. To build our new harmonious country, the People＇ s Court, should enjoy the power to decide which one needs the Reeducation through labor. The public security organization is only in charge of investigating, obtaining evidence, suing. The People＇s Procurator Organ should survey the public security organization strictly. The Reeducation through Labor should be opening and equitable.
