| 摘 要： | 1982年《联合国海洋法公约》对众多的国际习惯海洋法实施了法典化，同时也确立了许多新的国际海洋法制度。其中，印度尼西亚对群岛水域制度的形成作出了巨大贡献，进而维护了国家利益，但群岛水域中无害通过权、群岛海道通过权的行使方式还需通过进一步的国家实践予以明晰。印度尼西亚也是和平解决海洋划界争端的积极实践者，已与邻国签署了16个划界协定或条约，其中与澳大利亚的划界最有特色，确立了主权权利、管辖权重叠的区域。背负着“负责任大国形象”的中国，在21世纪应为当代国际海洋法的发展尽力。
