摘    要:为适应市场经济产权关系、劳动关系的变化,职工民主管理与职工代表大会制度应当立足于现代企业制度理论,转换职工民主管理以产权为依据的视角.法律对职工基于劳动合同关系、以劳权主体身份、用参与的方式介入企业管理进行系统化制度设计安排,要求参与管理通过劳资双方合意在企业经营管理过程中发挥作用.因劳动合同履行过程中无法规避强势产权作用,需要劳资双方在管理领域以组织行为互动,并且约束各自行为,维护双方的合法权益,从而达到劳动关系的协调.

Abstract:In order to meet with the changes of ownership relations and labor relations under marketing economy,the system of democratic management and Worker’s Congress should be grounded on the theory of modern enterprise system.Since the strong power of ownership can not be avoided in the process of implementing labor contract,labor and management should inter-act and restrain their behavior in management so as to protect legal rights and interests of both parties and to build up harmonious labor relations.
