浅谈证人合法权益及其保障

刑事证人是非常重要的刑事诉讼参与人。为保障刑事诉讼的顺利进行,证人应享有相应的诉讼权利。但是我国刑事诉讼法律及有关规定对证人的安全保障权、作证地点的选择权的规定有其局限性,影响了证人作证的积极性及刑事诉讼效率。本文就此问题进行了探讨,并提出了证人合法权益保障的完善措施。

Criminal witnesses are very important participants in a criminal lawsuit, so they should be entitled to relative rights to ensure the smooth progress of a criminal lawsuit. In our country, the criminal lawsuit system restricts the regulations to safety assurance rights and rights of choosing place to give evidence, which affects the witnesses' activeness to give evidence and the efficiency of a criminal lawsuit. The article gives a discussion concerning this question and puts forward measures of perfecting the system of ensuring the witnesses' legal rights.
