经济全球化与中国工会法的修改和实施

摘    要:中国对 1 992年《工会法》的修改 ,考虑了经济全球化问题 ,特别是相关的两个具体问题。其一 ,中国批准了《经济、社会及文化权利国际公约》。其二 ,中国加入世界贸易组织。《工会法》的修改及其实施 ,既要遵守有关国际公约 ,又要维护工会的团结统一。此外 ,必须改变传统的工作方式 ,借鉴国外的有益经验 ,充分肯定基本工人权利 ;又要反对劳工权利与国际贸易挂钩 ,体现中国工会的社会主义特色。这涉及到中国的劳动力成本、集体谈判和集体合同、跨国公司的生产守则、职工参与等问题。

Abstract:China considered the background of economic globalization, especially related to two things in the course of revision of Trade Union Law of the PRC(1992) last year. Firstly, China ratified an international convention --The International Convention of Economical, Social and Cultural Rights in 1997. Secondly, China joined the WTO in 2001. The revision and implementation of Trade Union Law of the PRC should not only abide by relating international conventions, but also protect the trade unions' unity. The Chinese trade unions should also change their traditional work way and use beneficial experience of other countries for reference and recognize the workers' rights. At the same time, the Chinese trade unions should oppose the standpoint that labor rights should link trade. That will reflect Chinese characteristics. This problem will relate to the cost of labor force, collective bargaining and collective contract, productive rules and workers' involvement management in transnational corporations.
