| 摘 要： | 2008年《中华人民共和国政府信息公开条例》的颁布和实施,标志着我国政府信息公开法律制度基本框架的初步形成。但从总体上来看还存在一些缺陷,如政府信息公开的立法位阶较低,政府信息公开条例本身不够完善,监督救济机制不健全,配套法律制度缺失等。实践中,应将公民的知情权作为一项基本人权上升到宪法层面,给予切实保护;适时制定政府信息公开法,提升公民知情权的法律保障水平;建立健全政府信息公开的救济制度,不断完善政府信息公开的法律体系。
