| 摘 要： | 拆封合同是计算机软件交易的主要形式,也是网络时代的新型格式合同。拆封合同的出现对传统的合同法则提出了新的挑战,有关拆封合同的一系列法律问题亟待解决。我国相关立法薄弱,应借鉴各国立法和司法实践经验,加以完善。

| Abstract: | Shrink-wrap contract is the major form in computer software transaction. It is also a new type of standard contract at Internet times. The rise of the shrink-wrap contract challenges the traditional contract law. The present paper, therefore, puts forward some advices to its legislation in China according to other foreign countries' legislation and administration of justice. |
