协同论——社会法的理论基础初探

经济运行、政治运行、文化运行的负外部性作用,决定了社会矛盾必然产生,为解决社会矛盾的社会立法也应运而生并不断发展;同时,社会本位的法哲学理念和私法社会化思潮对社会法理论的形成和发展产生了重要的影响;尽管社会法理论观点不尽相同,但最终还是可以归结为一个共同的基础———协同论。

Coordination as the Theoretical Basis of Social Law

The negative externalities in the operation of economic,political and cultural affairs make social contradictions a necessary result.And thus social legislation to solve such contradictions emerged and developed according to the process.Meanwhile,the notion of social orientation in legal philosophy and socialization of private law influence very much to the formation and development of social law.Although there are different views,a coomon basis could be found in the theory of coordination.
