| 摘 要： | 西方法理学在法学史的意义上被称为西方法律思想史,是生成于西方特定时空环境和独有的哲理基础上的法律思辩。若泛泛而论,作为法的一般理论的西方法理学甚至先于法学而出现。但是严格说来却是十九世纪法学分化的结果,法学是其原生形态。考察词源,西语“法理学”、“法哲学”虽为同义语,其意蕴却有所不同,中经复杂的语言流转,嬗变出现代汉语“法理学”的名称。

| Abstract: | Science of law derives from western countries, jurisprudence generates in it. Jurisprudence was separated from philosophy, which is the joint name of all original sciences. Like other disciplines, science of law appears a trend of polarization of jurisprudence and philosophy of law. Although they are synonyms, they still contain different meanings respectively. |
