| 摘 要： | 需求是法律创造之母,信息权的提出是信息社会对法律科学发展的客观诉求。作为当今社会经济生活的主体要素,信息成为独立法律客体,具有必然性。本文在对信息及信息权概念界定和特征概括的基础上,系统阐述了信息权所具有的四大权能;通过与国外信息立法的比较借鉴,分析了我国信息立法的现状及存在的问题;提出应针对我国当前信息司法实践中出现的各种问题,开展类型化研究,呼吁相关立法机构制定专门信息法律,以期形成体系严谨、内容统一、技术完备的信息法律部门与信息法律科学。
