| 摘 要： | 对驰名商标的侵权可结合侵权行为的主体及客体予以认定,其理论基础为＂禁止混淆＂和＂禁止联想＂。驰名商标侵权采用无过错归责原则。完善我国驰名商标侵权认定需转变我国立法中的理论基础,并坚持司法途径个案认定模式。
