完善我国红十字会监督机制的法律思考

当前我国红十字会监督机制面临诸多困境，缺乏制约实效，主要表现在五个方面：一是法定监督缺乏实效；二是内部监督制度不健全；三是缺乏独立的第三方监督机构：四是政府监督强制力不足：五是社会监督难以实践。究其原因主要为我国红十字会制度建设脱节，慈善法律不健全，内部管理缺乏专业性以及信息不透明。因此，完善红十字会相关立法，健全其内部自律机制，构建政府、社会和公众全方位监督网络，是我国红十字会重塑其公信力的有效手段，也是其未来可持续发展的方向和必由之路。

Legal Consideration on Improving the Supervision Mechanism of China＇s Red Cross

The current supervision mechanism of the Red Cross Society of China faces many difficulties, lacking of practical constraints. The problem has manifested itself in five aspects： Firstly, the statutory supervision lacks in actual effect; Secondly, the internal supervisory system is not perfect; Thirdly, there is lack of an independent third party to supervise; Fourthly, the force of govemment supervision is inadequate; Fifthly, the social supervision is difficult to practice. The main reason for this problem is that the system construction of the Red Cross Society of China is disjointed and the charitable laws are imperfect, with the lack of professionalism of internal management and opaque information. Therefore, improving the Red Cross relevant legislations with its internal self-regulatory mechanism and building the governmental, social and public monitoring network are not only effective means to restore the credibility of China＇s Red Cross but also its future direction of sustainable development and inevitable course.
