| 摘 要： | 审前羁押程序是刑事诉讼中的重要程序，与犯罪嫌疑人的权益密切相关。本文对大陆法系与英美法系的四个代表国家有关审前羁押适用法律制度做出详细的梳理，并对2012年修订的《刑事诉讼法》中有关审前羁押的修改做出评析，并在此基础上对我国未来构建审前羁押的司法审查制度做出相关设想。

| Abstract: | pretrial detention program is an important procedure in criminal action and closely related to the rights and interests of criminal suspects. In this paper, pretrial detention applicable laws of the four countries on behalf of continental law system and Anglo-American law system to make detailed intruduetion and the 2012 revision of the criminal procedure law of the change of pretrial detention to make evaluation. In the end of this paper, make relevant ideas in the future for building a system of judicial review of pre-trial custody in china. |
