检察机关的关系

我国已经初步形成了由纪律检查委员会、监察部门、检察机关组成的反腐败体系，然而在这一体系中存在着纪检监察机关与检察机关联合办案、各自职责分工不明确、当事人合法权益保障等等问题。本文依据我国现在的法律制度，结合我国当下反腐败体系中纪检监察机关同检察机关的关系，对纪检监察机关与检察机关之间的关系以及存在的问题进行阐述和分析，认为应当明确纪检监察机关与检察机关之间职责的区分，避免联合办案模式，保障检察机关独立办案及当事人的合法权益。同时对如何处理二者之间的关系提出一些建议。

The relationship of Discipline Inspection Organs with Investigating and Prosecuting Apparatus

Our country now have established the anti-corruption system which consists of discipline inspection organs and investigating and prosecuting apparatus . However , there are such problems in this system as discipline inspection organs work with investigating and prosecuting apparatus , responsibility is not clear , protect of the parties＇ right and so on . This article tries to probe the relationship and problems of discipline inspection organs and investigating and prosecuting apparatus in depth on the base of our law system . The major idea of is that the responsibility of these organs should be divided more clear and avoid to work together so as to protect the rights of the parties . Meanwhile , some advices about how to deal with their relation have been made in this article .
