我国劳动争议仲裁制度现状分析

摘    要:我国现行法律对于劳动争议采取"一调一裁两审"的单轨制解决途径,在内部调解机构调解之后和国家公权力介入进行强制裁决之前,劳动争议仲裁制度因其独有的模式、独特的成员构成、高效的运作方式以及相对经济的仲裁成本在解决众多劳动争议中起到了重要作用,同时也因为我国目前的劳动争议仲裁制度本身存有的问题引起了各方越来越多的关注。

Abstract:The present legal system takes the single-track measure to settle a labor dispute.If a labor dispute between the employing unit and a laborer arises,the parties may apply for mediation or arbitration or take the legal proceedings according to law.It has lots of distinctive features,such as unique composition of members,effec- tive mode of implementation and comparatively economical cost.Arbitration is significant to settle a labor dispute, but it has drawn more and more attention of society because of the problems on the arbitration system.
