| 摘 要： | 公示行为是物权与债权之间的联结所在,是债权变动为物权的必要条件之一,它可以为债权的履行行为所涵盖,而没有必要把它再拟制为一个独立的物权契约。实践证明,债权形式主义的物权变动模式不仅符合实践的逻辑,而且简洁实用,是较优的制度选择。

| Abstract: | Publish conduct is a connection between right in rem and right in personnam,and is a necessary condition from right in personnam to right in rem,which is included in the performing of right in personnam but is not taken as a independent contract of right in rem.It is affirmed in practice that the changing mode of right in rem in the light of the combining credit with formalism not only conforms to the logic of practice but also is simple and functional,which is a better systemic choice. |
