对我国犯罪构成体系的完善性分析

经过多年的实践检验及理论改进,可以认为我国刑法学界长期通行的犯罪构成体系在逻辑性和实用性两方面均无大碍,它基本能够胜任我国现阶段刑事司法"依法断案"的要求;但同时,社会的进步与知识的更新亦显露出它在诸多方面存有不足,因此,有必要根据司法的实际需要并借鉴域外刑法学的相关知识,对我国通说性的犯罪构成四要件体系,进行一些局部的调适和修正。

An Assessment of the Regime to Determine Coilstitution of a Crime

After years of practice and theoretical improvements,it can safely say that the long existing regime in China's criminal area to determine whether a crime is constituted functions well both in logic and in practice and has basically satisfied the requirement of "adjudication under law" of the criminal justice at present stage.However,confronting social development and updated knowledge the regime also betrays some defects.So it is necessary for us,in accordance with practical demand and by reference of relevant knowledge in foreign criminal law,to advance and update our common theory concerning the four requirements for determining the constitution of a crime
