论暴力维权——基于法社会学视角

暴力维权从本质上说,是一种显性的、为争夺利益的社会冲突。导致这一现象发生的原因有两个,即物质性原因和价值性原因。物质性原因是根本,是由于行为人对利益的追求以及向社会表达利益的渠道不畅;价值性原因是补充,是缘于行为人对朴素正义观的信仰与追求。在坚持制度正义的前提下,从立法、行政、司法三个维度进行相应的制度设计,方能化解冲突,遏制暴力。
