| 摘 要： | 海关行政裁定是指海关在货物进出口前应对外贸易经营者的申请 ,依据有关法律、行政法规和规章 ,对与实际进出口活动相关的海关事务做出的具有普遍约束力的决定 ,是一种判例式的行政执法行为。从裁定事项、表现形式、作用对象的范围以及需依申请而作出等方面看 ,海关行政裁定属于具体行政行为 ,具有可诉性。
