我国动物致害责任免责事由之探讨

免责事由是动物致害责任中必不可少的一部分,其关涉侵权责任制度对受害人利益保护和行为人行为自由之价值的平衡。但在学理上学者对其研究并不是很成熟,本文通过对免责事由基本原理的分析,具体探讨可作为动物致害责任免责事由的情形,以此为铺垫,对我国当前动物致害责任免责事由的规定进行评析,并进而提出应增加相关免责事由的构想。

Research on the Liabilities Exemption for Injuries Made by Animals in China

Liabilities exemption is a necessary part of liabilities for injuries made by animals,which is related to the balance between the protection to victims from tort liability system and the value of behavior’s freedom.However,scholars are not ripe in the study academically.The author analyzed the basic principle of liabilities exemption,discussed situations of liabilities exemption for injuries made by animals,evaluated the current regulations on liabilities exemption for injuries made by animals and put forward the ideas of increasing relative liabilities exemption.
