论正当化事由错误

正当化事由错误与事实错误有相似之处,但是,由于它并不属于犯罪论体系上的构成要件,可以归属于违法性问题,因此,又与违法性错误有近似之处。有关正当化事由错误的理论界说,大陆法系的理论界定相对明确一些,聚讼的焦点主要围绕在违法性阻却事由错误的理论认识与归类的问题上。与此相比,我国学术界对正当化事由的界说,缺乏完整的认识,传统的归入事实错误说似乎已成定论。在我国的刑法理论界,有关正当化事由错误问题基本上不存在激烈的争鸣,偶有一些新的论点,也很难与事实错误说相颉颃。

On the Subject of Grounds for Legitimate Mistakes

Though grounds for legitimate mistakes are similar to factual mistakes,it is not the element of crime system which can be attributed to illegal issues;therefore,it has a similarity with illegal issues.As to the theory definition on the subject of ground for legitimate mistakes,the Civil law is relatively clear,which mainly focuses on the understanding and classification of ground for elimination of misfeasance mistakes.Compared with the argues above,the academia in China,since the lack of complete understanding of grounds for legitimate mistakes,has traditionally classified it factual mistakes that seemed a foregone conclusion.In China's law theory field,though occasionally,there are some new arguments,there is basically no fierce contention on the subject of grounds for legitimate mistakes,so it is difficult to say with the factual mistakes.
