| 摘 要： | 挪用公款罪是一种较为常见的职务犯罪。在司法实践中,由于案情的复杂多变,法律规定本身并不详尽,导致挪用公款罪的认定和处罚在实务界并不统一。文章运用刑法理论,结合实践,对该问题进行探讨,以期对实务部门办案提供法律依据。

| Abstract: | Embezzlement is a very common post crime. In judicial practice, the legal provision itself is not exhaustive enough because of complex and changing cases, and this causes the identification and punishment of embezzlement are not unified in practice. The article makes a discussion on the issue through combining criminal law theory with practice, hoping to provide legal basis for substantive departments to handle cases. |
