| 摘 要： | 刑事撤案监督在我国法律适用的过程中遇到了许多新情况、新问题,这与其在我国法律适用过程中存在法律理论与司法实践的结合不够有密切联系。文章在分析我国立法现状及缺陷的基础上,提出产生这些问题的原因,并对如何建立刑事撤案检察监督提出了合理化建议。

| Abstract: | Supervision of withdrawing criminal cases encounters many new situations and new problems in the appli- cation of law in China,which is closely linked to the inadequate combination between legal theory and judicial prac- tice during the application of our laws. On the basis of analyzing China＇ s legislative status quo and defects, the arti- cle provides the causes to these problems and puts forward a reasonable recommendation on how to establish prosec- utorial supervision of withdrawing criminal cases. |
