| 摘 要： | 我国现行的公诉权监督制约机制以不起诉权的监督制约为重心,对起诉权滥用的监督制约仍有不足。谨防公诉权滥用,不仅应当进一步强化对公诉权的外部监督,完善公诉权的内部监督制约机制,更应进一步提高公诉人素质,提升执法水平。

| Abstract: | The focus of China＇ s current supervision and restriction of prosecution right is the supervision and re- striction of non - prosecution, but there is not sufficient supervision and restriction on the abuse of the right of prose- cution. In order to beware the abuse of right of public prosecution, we should not only further strengthen the external supervision of the prosecution right and improve its internal mechanism of supervision and restriction, but also should improve the quality of the public prosecutors and enhance the level of law enforcement. |
