| 摘 要： | 本文关于《中华人民共和国刑法修正案（七）》第13条中“与离职的国家工作人员关系密切的人”在司法实践中的理解与认定的探讨,认为只要是行为人与国家工作人员具有一定的关系,通过其他国家工作人员职务上的行为,为他人谋取了不正当利益,收取他人财物,其行为即构成斡旋受贿罪。

| Abstract: | This paper discussed the understanding and identification of＂the close person to the national dimission staff＂in Article 13 of＂Criminal Law Amendment（Ⅶ） of The People s Republic of China＂,found that as long as the perpetrators have a certain relationship with the national staff,through the behaviors of the other national staff,to seek an unfair advantage for others and collect other people s property,their behavior should be sentenced mediate bribery crime. |
