论公安机关实现宽严相济刑事政策之途径

在当前我国刑事法制背景下，宽严相济刑事政策的主张重点在“宽”，而非“严”。面对轻微犯罪大量发生造成的刑事立案总数居高不下，暴力性恶性犯罪愈演愈烈，给“命案必破”的工作目标带来压力，新型的社会越轨行为不断涌现，给公安执法实践带来困扰的局面，公安机关应该在科学界定宽严相济刑事政策的基础上，从执法理念更新、程序解读、实体运用等三个方面探讨实现宽严相济刑事政策的途径。

On the Ways of Realizing Criminal Policy of Temper Justice with Mercy by Police Security Organ

Under the present criminal legal system background of our country,the focus of criminal policy of temper justice with mercy is "lenient" not "severe".The facts that slight crimes committed in great number keep the number of the filing of criminal cases increasing,and that malignant crimes grow in intensity bring the pressure to the goal of " deadline for the homicide case ",and the emergence of the new social impermissible behavior makes it perplexing for public security men to enforce the law.The public security organ,based on the scientific definition of criminal policy of temper justice with mercy,should discuss its realizing ways from the three aspects of the renewal of law enforcement,the understanding of the procedure,and the application of the entity.
