行为法学的发展和中国法律体系的科学构建

我国的法律体系应当是以公法、私法划分为内在特征 ,以实体法和程序法的多层对应关系为外部表现的二元化的法律体系 ,其中 ,内在的二元化体现了民主政治社会二元分化的社会需求 ,外在的二元化成就了法律的不同功能对社会的调整作用。行为法学无论是作为一种方法论 ,抑或是一个独特的研究领域、一种学派、一种法学思潮、一种法学学科等 ,都将以一种新的视角来看待和研究我国的法律现象和法律制度 ,并将在多视觉和多元的学术组织中促进我国法学的繁荣 ,也必将促进我国法律体系的更新和完善 ,较传统法学更有益于“二元”法律体系的形成。

The Development of Behavioral Jurisprudence and The Scientific Establishment of Chinese Legal System

The legal system should be a dual one, with public law and private law as its internal feature and with a multi-section corresponding relations between the substantial law and procedural law as its external behavior. Among them the internal duality shows the dual needs of the society of democratic politics and the external duality makes the adjusting functions of law applying to the society. Behavioral jurisprudence, as a methodology, a new field, a school, a academic theory or a legal science, is different from the traditional one and is based on a new envision to the research on the legal phenomenon and systems. It will necessarily advance the renewal and perfection of the legal system in our country, as well as the prosperity of the jurisprudence in the multi-elements atmosphere, and be more conducive to the formation of dual legal system than the traditional one.
