论法律渊源--以法学方法和法律方法为视角

从法律方法的角度看法律适用是一个关于“法律是什么”的认识理性 ,而法律适用中法律渊源内部冲突的解决是一个“如何实现法律”的技艺理性。从两者的关系上看 ,认识“法律是什么”是“如何实现法律”的起点 ,“法律是什么”也仰赖于“法律如何实现”

On Source of Law--From the Perspective of Legal and Jurisprudence Methodologies

In the democratic society, once the disputes go into the frame of law, there must be legal basis. However, where can we find the law? How can we detect the law from a large number of laws? How can we deal with the contradictions, wrongs, gaps and unconstitutional laws when we applying the laws? All of these questions are the problems about the sources of law in jurisprudence. The article classifies these questions from the perspectives of legal and the jurisprudence methodologies. On one hand, the types of China sources of law system are analyzed from the position of positive law; this process is the beginning of law application. On the other hand, we will be committed to resolving all kinds of conflicts in the sources of law.
