食品安全领域黑名单管理措施的可诉性分析

近年来,各地陆续开始在食品安全领域使用黑名单管理措施,通过对黑名单的管理来加强对食品安全生产经营者的重点监管.但在黑名单管理措施受到食品安全监管部门青睐的同时,我们应思考这种管理措施的性质,特别是经营者对于食品安全监管部门将其列入黑名单的行为,能否提起行政诉讼,尤其需要探讨.根据各地关于黑名单管理措施的规定,可以将食品安全领域的黑名单管理措施分为两种,一种是行政处罚行为,另一种是行政事实行为.根据《行政诉讼法》的规定,行政事实行为不属于行政诉讼受案范围,但是根据《国家赔偿法》的规定可以对行政事实行为提起行政赔偿诉讼.行政处罚行为属于我国《行政诉讼法》明确列举的受案范围,可以对此种类型的黑名单管理措施提起行政诉讼.

Analysis of the Actionability of Food Safety Blacklist Management Measures

In recent years,one after another around the beginning of black list management measures in the field of food safety, through to the blacklist management to focus on strengthening the supervision of food safety production operator.But in the blacklist management measures by the food safety supervision department favored the same time ,we should think about the nature of man- agement measures,especially the operators to blacklist behavior for food safety supervision department,can bring an administrative lawsuit,need to explore in particular. Based around a blacklist management measures,to the field of food safety blacklist manage- ment measures are divided into two kinds,one kind is the act of administrative punishment;the other is the administrative fact be- havior. According to the ＂Administrative Procedure Law＂,the administrative fact behavior does not belong to the scope of adminis- trative litigation,but according to the ＂State Compensation Law＂ can bring an administrative litigation on administrative fact behavior. Administrative punishments belongs to China＇s ＂Administrative Procedure Law＂ expressly listed scope,may bring an administrative lawsuit in this type of blacklist management measures.
