| 摘 要： | 设立刑事被害人国家补偿制度是为了救助千千万万遭遇不幸的人，给那些无助的被害人送去希望，使他们从刑事犯罪对他们身心造成的伤害的阴影中走出来。国家补偿制度的核心问题是到底应该补偿什么样的人，即谁有资格获得国家补偿的问题。文章从六个方面进行了探讨，对这个问题给出了自己的答案。
