论以民法补充海商法的单位

一直以来，“以民法补充海商法”的原则成为国内学者和实务界解决海商法与民法之间的法律冲突、补充《中华人民共和国海商法》立法漏洞的惯用思维；然而，这一原则的模糊性导致对以民法补充海商法的单位是事项还是要素产生争议。从《中华人民共和国立法法》与《中华人民共和国海商法》具体条文出发，通过法律解释得出民法补充海商法的单位是事项而非要素的初步结论；进而结合海商法的外来性和海上责任的独立性进行理论分析，对以上初步结论进行进一步印证；在此基础上提出对海商法研究与《中华人民共和国海商法》修改的建议。

On units of supplement to maritime law from civil law

For all the time, the principle of supplying maritime law with civil law is an essential approach in China in solving with legal complicit between maritime law and civil law as well as the legal flaw in maritime law. However, the fuzziness of this principle raise up the question of what is the supplement unit for supplying maritime law with civil law？ Items or elements？ Begin with legal interpretation of two specific institution of Legislative Law of the People＇s Republic of China and Maritime Code of the People＇s Republic of China, this paper reaches a preliminary conclusion. Then, with further theoretical anal- ysis of the foreign element of maritime law and the independence of maritime liability, the paper gives the final conclusion that the unit for supplying maritime law with civil law is ＇ items＇. Further more, some suggestions are brought forward concerning the amendment of Maritime Code of the People＇ s Republic of China and the research work in maritime law.
