宽严相济视野中少数民族刑事政策的发展与完善——以西北少数民族地区为视角

历史上形成的“少捕、少杀，处理上一般从宽”的少数民族刑事政策有其相当的合理性，体现了对少数民族的人文关怀和司法宽容，在实践中得到了包括西北少数民族在内的各族公民的认同，取得了良好的效果。但这项刑事政策也有其历史局限性，新形势下，应当以“宽严相济”刑事政策为基石，关注“两少一宽”政策的刑事法律化，明确“两少一宽”并非少数民族刑事政策的全部，丰富少数民族刑事政策的内涵，促进法治和其他正义而有效的社会控制资源的结合，才能真正发挥其维护社会和谐稳定之功能，不应忽视包括西北少数民族在内的各少数民族固有资源在控制犯罪中作用的发挥。

The Development and Perfection of Minority Criminal Policy in the Field of Temper Justice with Mercy—— From the Angle of Northwest Minority Areas

The formation of "less arrest and less kill,handle with general mercy" criminal policy of ethnic minorities in the history has its considerable reasonability and represents humane care and judicial tolerance for the minority.It has been recognized in practice by all nationalities including the Northwest minorities and has achieved good results.But this criminal policy has its historical limitations.Under the new circumstance,we should concern the criminal law of "two less and one mercy" policy on the basic of "the temper justice with mercy criminal policy"and make it clear that "two less and one mercy "is not all of the minority criminal policy.Only by enriching the connotation of criminal policy of ethnic minorities and promoting the combination of the rule of law and other social justicial and effective control of resources,can we truly play its functions of maintaining social harmony and stability.At the same time,we should not overlook the function of inherent resources including the Northwest minorities in controlling the crime.
