合同自由的歧视性限制——房地产“限购令”的民法透视

摘    要:无论房价高企是否源于投机性购房,借助身份控制的任何限购行为都具有可非难性。商品房买卖合同的缔约权基于户籍而实现,户籍由公共产品的差异性分配机制变成民事权利的取得资格,构成对合同自由的歧视性限制。限购令颁布后,户籍审查成为商品房买卖合同产生物权变动的形式要件,合同当事人因合同目的落空享有法定解除权,而房屋名义所有权人与真实所有权人不一致的情形随之激增;建议未解除买卖合同的被限购对象以保障将来债权为由,申请办理预告登记。

Abstract:All kinds of restricts for house-purchase by means of identity controlling are accusable no matter whether the high prices due to property speculation or not.According to the policy of restricts for house-purchase,the right to contract depends on identity register.
