| 摘 要： | 刑法的工具性是任何一个国家的刑法规范所不可避免的社会现象.我国近现代刑法移植于近现代西方刑法文化.刑法移植中的背景因素使刑法移植的活动从一开始就因被赋予富国强民的目的性而具有强烈的工具主义色彩.从清末刑法、民国刑法直至新中国刑法,刑法立法目的、刑法规范内容以及刑法的实施过程,其工具性价值取向非常明显.
